1. Acceptance of Terms

By accessing or using AI Receptionist ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms apply to all visitors, users, and customers of AI Receptionist.

2. Description of Service

AI Receptionist provides AI-powered phone answering and website chat services for businesses. This includes:

  • Automated call handling and intelligent conversation
  • Website chat widgets and visitor engagement
  • Appointment booking and calendar integration
  • Lead capture and CRM synchronization
  • Call recording, transcription, and analytics
  • Outbound call campaigns

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information as needed
  • Keep your login credentials confidential
  • Notify us immediately of any unauthorized account access
  • Be responsible for all activity under your account

4. Subscription and Billing

4.1 Fees

You agree to pay all fees associated with your selected subscription plan. Fees are billed in advance on a monthly or annual basis as selected during signup.

4.2 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. Cancellation takes effect at the end of the current billing period.

4.3 Refunds

We offer a 14-day money-back guarantee for new subscriptions. No partial refunds are provided for partial billing periods after the guarantee period.

4.4 Price Changes

We reserve the right to modify pricing with 30 days' notice. Price changes will not affect your current billing period.

5. Acceptable Use

You agree not to use the Service for:

  • Any unlawful purpose or in violation of any applicable laws
  • Spam, robocalling, or unsolicited telemarketing
  • Harassment, threats, or abusive behavior towards callers
  • Impersonating any person or entity
  • Collecting sensitive personal information without consent
  • Any activity that interferes with or disrupts the Service

6. Call Recording and Consent

You are responsible for:

  • Complying with all applicable laws regarding call recording consent in your jurisdiction
  • Configuring your AI Receptionist to provide appropriate disclosures to callers
  • Obtaining necessary consent before recording calls where required by law
  • Maintaining records of consent as required by applicable regulations

We provide tools and configuration options to help you meet these obligations, but the ultimate responsibility rests with you.

7. Intellectual Property

The Service, including its software, AI models, branding, and content, is owned by AI Receptionist and protected by intellectual property laws. You retain ownership of your business data, content, and configurations. We claim no intellectual property rights over the information you provide.

8. Data Handling and Privacy

Our collection and use of personal information is governed by our Privacy Policy. You retain ownership of your business data. We use call recordings and transcripts to improve our AI models, using anonymized and aggregated data.

9. Service Level and Availability

We strive for 99.9% service uptime. Our SLA includes:

  • Guaranteed 99.9% monthly uptime for the core service
  • Automatic failover to backup call handling
  • Service credits for verified downtime exceeding SLA thresholds

10. Limitation of Liability

To the maximum extent permitted by law, AI Receptionist shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold AI Receptionist harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of applicable laws, including call recording consent requirements.

12. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access for violation of these terms, with notice. Upon termination, your data will be available for export for 30 days before permanent deletion.

13. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

14. Governing Law

These terms shall be governed by the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Pierce County, Washington.
